Governing Law and Dispute Resolution:
All agreements between Pen & Pixel and the customer, as well as these general terms and conditions, are governed by Dutch law. Any disputes shall in the first instance be submitted to the competent court in the district where Pen & Pixel has its registered office.
Online Dispute Resolution (ODR):
Consumers have the option to resolve disputes arising from online purchases out-of-court via the European Commission’s Online Dispute Resolution (ODR) platform. This platform can be accessed via the following link: https://ec.europa.eu/consumers/odr/. Pen & Pixel is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
Liability:
Pen & Pixel acts as an intermediary between the customer and the production and shipping partner, Printful. Our liability is limited to the obligations expressly described in this agreement. We are not liable for:

Delays or errors caused by our production partner Printful, carriers, or customs authorities.

Colour, size, or product deviations that are inherent to the print-on-demand process and fall within Printful's technical tolerances.

Indirect damages, consequential damages, or lost profits.
Our total liability in any event shall never exceed the purchase price of the relevant product.
Intellectual Property:
All designs, logos, texts, and images on the Pen & Pixel website are our intellectual property or are used with permission. It is not permitted to copy, reproduce, or distribute these materials for commercial purposes without our express written consent.
Customers warrant that any designs or texts they provide for personalisation do not infringe the intellectual property rights of third parties. The customer shall fully indemnify Pen & Pixel against any claims arising therefrom.
Privacy:
We process personal data in accordance with our Privacy Policy. This policy describes how we collect, use, and protect data, and how customers can exercise their rights. Our Privacy Policy can be consulted via: [LINK to your privacy policy].
Third-Party Services (Printful):
Our products are manufactured, packaged, and shipped by our trusted partner Printful Inc., an established print-on-demand service provider. By placing an order, the customer accepts that their necessary shipping details (name, address) will be shared with Printful to fulfil the order. Printful maintains its own general terms and conditions and privacy policy for its services.
